Acceptable Use Policy

Last updated: 15 September 2025

This Acceptable Use Policy (“Policy”) governs the use of EPC Hub’s website, platform, and services (collectively, the “Platform”). It forms part of EPC Hub’s Terms and Conditions. By creating an account, accessing, or using the Platform, you agree to comply with this Policy.

1. Purpose

The Platform is provided to connect homeowners (“Customers”) with accredited Domestic Energy Assessors (“Assessors”). It must only be used for lawful purposes and in accordance with this Policy.

2. Security & Account Obligations

You are responsible for keeping login details confidential and must not share your account.

You must use strong, secure passwords and update them regularly.

You must notify EPC Hub immediately of any suspected misuse, unauthorised access, or data breach.

EPC Hub may suspend or terminate accounts where security is compromised.

3. Prohibited Activities

You must not:

Tamper with the Platform – including hacking, malware, scraping, reverse engineering, or disrupting services.

Provide false information – including fake qualifications, misleading pricing, or fraudulent EPC certificates.

Exploit or harass others – including abusive, discriminatory, or defamatory behaviour.

Misuse content – including manipulating reviews or posting fake feedback.

Breach data laws – using personal data for non-legitimate purposes.

Automated access – bots, scrapers, or automated tools.

Advertise unauthorised services – spamming or soliciting off-platform.

Engage in unlawful activity – fraud, money laundering, or regulatory breaches.

Infringe EPC Hub’s IP – copying, re-selling, or creating derivative works from our platform, data, or branding.

Breach confidentiality – disclosing EPC Hub’s non-public information.

Cause reputational harm – making false or misleading public statements about EPC Hub.

Conflict of interest – promoting or operating competing services via EPC Hub.

4. Assessor Obligations

Assessors must:

Hold valid accreditation and comply with all relevant laws and standards.

Provide services with reasonable skill and care.

Honour bookings and provide accurate details.

Not circumvent EPC Hub when dealing with Customers.

5. Monitoring & Audit Rights

EPC Hub may monitor activity and audit accounts to ensure compliance.

6. Enforcement & Consequences

EPC Hub may remove content, suspend accounts, or terminate access at any time.

Termination may be “for convenience” with notice, or immediate without notice if fraud or risk is suspected.

Payments may be withheld where misuse is suspected.

EPC Hub may seek injunctive relief to stop ongoing breaches.

EPC Hub may recover damages, liquidated damages, and enforcement costs.

7. Content Licence

By posting content (e.g., reviews, text, images), you grant EPC Hub a perpetual, royalty-free licence to use, reproduce, display, and moderate it.

8. Indemnity & Costs Recovery

You agree to indemnify EPC Hub, its directors, staff, and affiliates for all claims, damages, losses, and legal or enforcement costs caused by your breach.

9. Limitation of Liability

EPC Hub shall not be liable for indirect or consequential losses. Liability is capped at the fees you paid to EPC Hub in the 12 months before the claim.

10. General Provisions

No Waiver – not enforcing rights once doesn’t waive them.

Severability – if part is invalid, the rest still applies.

Entire Agreement – this Policy and EPC Hub’s Terms are the whole agreement.

Force Majeure – EPC Hub isn’t liable for failures caused by events beyond its control (IT outages, pandemics, disasters, strikes).

Third-Party Rights – no third party has rights under this Policy.

Assignment – EPC Hub may assign its rights without consent.

Survival – confidentiality, indemnity, liability, IP, and non-circumvention survive account closure.

Class Action Waiver – disputes must be pursued individually, not as group claims.

Export Control & Sanctions – EPC Hub cannot be used in violation of UK export laws or sanctions.

11. Governing Law & Disputes

Governed by English law, regardless of user location.

Courts of England and Wales have exclusive jurisdiction.

Disputes must first go through EPC Hub’s complaints process, then mediation/arbitration (confidential) before litigation.

This Policy is drafted in English; the English version prevails.
